Terms & Conditions
The terms that apply to your use of this website and to the services Verton Estimator LLC provides.
1. Agreement
By using vertonestimator.com or engaging Verton Estimator LLC for services, you agree to these Terms & Conditions. Project-specific terms in a signed proposal or agreement take precedence where they differ from these terms.
2. Services
Verton provides construction estimating, quantity takeoff, drafting, design support, project cost support, and BIM modeling services based on documents supplied by the client. The scope, deliverables, fee, and delivery date for each project are defined in a written proposal.
3. Client responsibilities
- Provide complete, legible, and current drawings, specifications, and addenda.
- Confirm the scope, trades, and level of detail required.
- Ensure you have the right to share the documents you provide.
- Review deliverables and raise questions promptly.
4. Nature of estimates
Estimates are professional opinions of probable cost based on the documents and information available at the time of preparation. They are not guarantees of actual construction cost, bid results, or subcontractor or supplier pricing. Market conditions, design changes, site conditions, and other factors outside our control may cause actual costs to differ. Clients remain responsible for their final bid amounts and contractual commitments.
5. Professional limitations
Verton does not provide licensed architectural or engineering services, does not seal drawings, and does not perform on-site inspections or surveys. Drafting and modeling services that require a licensed professional are performed under the direction of the client's design professional of record.
6. Fees and payment
Fees are stated in each proposal or agreement. Published prices are starting points; final fees depend on project size, complexity, drawings, and scope. Payment terms are stated in the proposal or agreement.
7. Revisions
Corrections to errors in our own work are made at no additional charge. Revisions resulting from new or changed drawings, addenda, or changes in scope after delivery are billed according to the proposal or agreement.
8. Intellectual property
Upon full payment, the client may use deliverables for the project for which they were prepared. Verton retains ownership of its templates, methods, and tools. Client documents remain the property of the client or their owners.
9. Confidentiality
We treat client documents and project information as confidential and use them only to perform the services, except where disclosure is required by law.
10. Limitation of liability
To the maximum extent permitted by law, Verton's total liability arising out of any project shall not exceed the fees paid for that project, and Verton shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or lost bids.
11. Website use
Website content is provided for general information. You agree not to misuse the website, attempt unauthorized access, or upload malicious files.
12. Governing law
These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, unless otherwise stated in a signed agreement.
